Intellectual Property Query – Copyright?


I run a website, on which betting ‘tipsters’ sell tips. The problem I have is that one of my tipsters is being accused of relaying another persons work. I am not sure of whether these allegations are true or false but the guy accusing him said he will be suing my company for IP theft.
I understand the concepts of IP Law and Copyright but am not sure if it applies to this situation. Just so you understand a little, the guy making the accusations has a program which uses data on horses form to rate them with the top rated being at the top and the worst at the bottom. He charges about £35 a month for this information.
He is claiming that up to 85% of my tipsters horses are the same as his ‘top rated’ horses. So is therefore threatening to sue, I was just wondering if there is any scope to what he is saying as to me its 1 horse in a race of say 7, there is always going to be people who tip the same horse?
He said its a breach of his Disclaimer from which part of it states:
ILLEGAL SHARING OF DATA
You must not share via any medium (Facebook, Twitter, Email, Website) ANY ratings data, best bets,
forum information or any data accessed as part of your FormBet Private Membership. Starting A Lettings Agency?


Me and my brother are starting a house/flat lettings agency. We are aiming to target a niche market, the DSS, pets, etc property hunter.
Currently I work as an insurance broker, as such I have a good knowledge of financial obligations that we will need to fulfill.
Really I am only looking for any additional advice that anybody may have, such things as approaching potential landlords, getting them to accept DSS, etc.

Would You Be Upset About This? What Should I Do!?


I started a very nice and productive garden that was producing a lot of food. Enough to where I was going to sell excess at the farmers market.
It was all organic too, nice and healthy, and rare varieties was my niche.
Well, my parents didn’t really agree with what I was doing with my life, even my mom told me to “get a life” even though I’m the first in the family to hold a degree from a prestigious university.
Well, after awhile, my Mom and I just didn’t get a long, and she is a very mean and nasty person, so I ended up having to leave because she drove me out of there.
So I had to leave my garden and my start up business behind because of my parents drove me out.
They knew exactly what I was doing and they saw it was a success.
Now I have no garden, and I had to leave all my pounds of peppers and tomatoes etc behind just as it was fruiting.
So now, I don’t even want anything to do with my parents.
I even had a dream about just avoiding my Dad and not feeling bad for it because of what they did to me.
I met some other people my age who live on their parents property (They’re whole family lives next to each other), and he has tons of land, and his grandpa next door does too.
His family SUPPORTS him and he’s doing the same things sort of.
He offered me a small plot to garden on, but said he couldn’t get me a job or anything.
With it being so late in the season, and my parents kicking me out before I could harvest my produce, I don’t even know what to do!
I want to garden on his property, but then again, I need to make a living and avoid being homeless

Do I Have To Change The Carpet In A Commercial Lease If It Has A Different Companies Logo On It?


I’m opening a family entertainment center. The facility was leased and operated as a family entertainment center a couple of years ago, let’s say “JJ”. Do i need to replace the carpet if it has the JJ logo, if I am not affiliated with them? If I don’t replace it, can I be sued by JJ’s? I am leasing the property, as is, from the same property manager that leased it to “JJ”. Thanks.

Does This Waiver Waive My Right To Share My Negative Experiences With A Company I Dealth With?


I just had a terrible experience with a company who laid down vinyl flooring. I asked that they come and tear up the floor and refund my money. They have honored this request, but are making me sign the below waiver. They tell me that me signing this waiver removes my right to post about my experiences with their company on any review website. Could any of you read this and tell me what provision of this waiver unambiguously states that I am not allowed to publicly share my negative experiences with this company in a public forum? Remember, it cannot be considered ambiguous. Thanks.

Is This A Good Description Of The Far-right As A Cult?


It is a cult founded on a number of dogmatic beliefs that have no basis in reality. These are people who believe that the inflection point of the Laffer Curve is somewhere in the low single digits, and that cutting taxes to insanely low levels will magically lead to revenue increases. These are people who believe that government itself is basically unnecessary but for a private property protection scheme, and that the unfettered market will provide all that society needs, and will dole out the appropriate price for all goods, wages and services with zero inflation through the magic of the market. These are people who believe it is impossible for humans to affect the climate, and that it is better for humans to attempt to magically adapt somehow to a much hotter world than to do anything to even curb the behaviors that might be making it hotter. These are people who believe that the proper way to punish corporate evildoers is to not punish them at all, because people will simply stop purchasing from corporations that poison their water and air and crash their economies–because the average consumer presumably has the secret market-given wisdom, and magic powers necessary to make financial choices to punish Koch Industries and Goldman Sachs if necessary.
